Welcome to PropVida (“PropVida,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern access to and use of propvida.com, including all listings, tools, membership plans, and services offered on the platform (collectively, the “Platform” or “Services”).

By accessing or using PropVida, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform.

1. Definitions

“User” means any individual or entity accessing the Platform, including Buyers, Sellers, Agents, Agencies, Landlords, and Tenants.
“Property” means any real estate, plot, residential or commercial unit, or rental unit listed on the Platform.
“Listing” means a Property advertisement posted by a User for sale or rent.
“Buyer” means a User seeking to purchase a Property.
“Seller” means a User (individual owner, or Agent/Agency acting on an owner’s behalf) offering a Property for sale.
“Agent” means an individual real estate professional registered on the Platform to post Listings on behalf of clients.
“Agency” means a registered real estate business/firm operating under a company profile on the Platform.
“Landlord” means a User offering a Property for rent.
“Tenant” means a User seeking to rent a Property.
“Membership” means a paid or free subscription plan governing the number of Listings a User may post and their validity period.

2. Eligibility

2.1 Users must be at least 18 years old and legally capable of entering into binding contracts. 2.2 Agents and Agencies must hold valid, current government or industry-issued licenses/registrations where required by local law, and must provide proof of the same upon request. 2.3 PropVida reserves the right to verify identity, ownership documents, or business credentials before activating or continuing an account.

3. Account Registration

3.1 Users must provide accurate, current, and complete information during registration and keep it updated. 3.2 Each User is responsible for maintaining the confidentiality of login credentials and for all activity under their account. 3.3 PropVida may suspend or terminate accounts found to contain false, misleading, or fraudulent information. 3.4 One Agency profile may have multiple linked Agent sub-accounts, subject to the Agency’s Membership plan limits.

4. Membership Plans, Listing Validity & Listing Limits

4.1 General. Access to post Listings is governed by the Membership plan a User selects or is assigned. Membership determines (a) the maximum number of active Listings permitted at any time, and (b) the validity period during which a Listing remains publicly visible.

4.2 Membership Tiers. PropVida offers different Membership plans for Individuals, Agents, Agencies, and Landlords. Each plan defines its own maximum number of active Listings permitted at any time and the validity period for which a Listing remains publicly visible before it must be renewed or upgraded. Current plan names, listing quotas, validity periods, and pricing are published and maintained separately on the Pricing/Membership page of the Platform and may be updated by PropVida from time to time.

4.3 Listing Expiry. Upon expiry of the validity period, a Listing will be automatically deactivated or hidden from public search. Users may renew, relist, or upgrade their Membership to reactivate or extend a Listing.

4.4 Exceeding Limits. If a User’s active Listings exceed their current plan’s limit (e.g., due to a downgrade), the oldest or lowest-priority Listings may be automatically deactivated until the count complies with the plan.

4.5 Upgrades/Downgrades. Users may upgrade their Membership at any time for immediate access to higher limits. Downgrades take effect at the end of the current billing/validity cycle.

4.6 No Guarantee of Results. Membership plans control visibility eligibility and quota only. PropVida does not guarantee inquiries, leads, sales, or rentals resulting from any Listing or plan.

4.7 Fees & Refunds. Membership fees, where applicable, are non-refundable except as required by law or as expressly stated in a separate refund policy. Fees are exclusive of applicable taxes unless stated otherwise.

4.8 Featured/Promoted Listings. Optional paid add-ons (e.g., featured placement, homepage promotion) may be offered separately from base Membership plans and are governed by their own terms at time of purchase.

5. Terms for Property Sellers

5.1 Sellers confirm they are the legal owner of the Property or are duly authorized (e.g., via Power of Attorney or engagement letter) to sell it. 5.2 Sellers must provide accurate details: price, location, area, ownership status, legal clearances, and photographs that genuinely represent the Property. 5.3 Sellers are solely responsible for the accuracy of pricing, title, and legal status of the Property. PropVida does not verify ownership or title unless explicitly stated as a value-added service. 5.4 Sellers must promptly mark a Listing as “Sold” or remove it once the Property is no longer available, to avoid misleading Buyers. 5.5 PropVida is not a party to, and assumes no liability for, any sale transaction, negotiation, or agreement between Seller and Buyer.

6. Terms for Property Buyers

6.1 Buyers are responsible for independently verifying Property details, ownership, legal title, encumbrances, and pricing before making any payment or entering into an agreement. 6.2 PropVida strongly recommends Buyers conduct due diligence, including legal and physical inspection of the Property, before any transaction. 6.3 PropVida does not guarantee the accuracy of any Listing content posted by Sellers, Agents, or Agencies and is not liable for any loss arising from reliance on such content. 6.4 Any payment, token amount, or booking amount exchanged between Buyer and Seller occurs directly between the parties; PropVida is not a facilitator, escrow agent, or guarantor of such transactions unless explicitly offered as a distinct paid service.

7. Terms for Agents and Agencies

7.1 Agents and Agencies must hold valid licenses/registrations as required under applicable local real estate regulations. 7.2 Agents/Agencies may only list Properties they are duly authorized to market and must be able to produce authorization documentation upon PropVida’s request. 7.3 Agencies are responsible for the conduct of all Agents operating under their Agency profile, including the accuracy of Listings posted by such Agents. 7.4 Agents/Agencies must not post duplicate, fake, expired, or “bait” Listings (Listings advertised to attract inquiries for Properties not actually available). 7.5 Commission, brokerage, or service fees charged by Agents/Agencies to Buyers, Sellers, Landlords, or Tenants are independent arrangements between those parties and are not set, collected, or guaranteed by PropVida. 7.6 PropVida may audit, request supporting documents for, or remove any Agent/Agency Listing suspected of violating these Terms.

8. Terms for Landlords and Rental Listings

8.1 Landlords confirm they have legal right to lease the Property and that the Property is free from disputes preventing lawful rental. 8.2 Rental Listings must accurately state rent amount, security deposit, maintenance charges, lease duration, furnishing status, and applicable restrictions (e.g., tenant type, pets, bachelors). 8.3 PropVida does not draft, review, notarize, or enforce rental/lease agreements. Landlords and Tenants are responsible for executing a legally valid rental agreement independently. 8.4 Landlords are responsible for complying with local rent-control, tenancy, and registration laws applicable to their jurisdiction.

9. Terms for Tenants

9.1 Tenants must independently verify the Property, ownership/rental authority of the Landlord, and the terms of tenancy before making any payment. 9.2 Any security deposit, advance rent, or brokerage paid by a Tenant is a direct transaction with the Landlord/Agent and is not processed, held, or guaranteed by PropVida. 9.3 PropVida is not responsible for disputes arising from rental agreements, deposit refunds, maintenance issues, or eviction matters between Landlord and Tenant.

10. Terms for Individual Users

10.1 Individual Users (private property owners not operating as a business) may list Properties for personal sale or rent, subject to the applicable Membership plan’s Listing limits and validity. 10.2 Individual Users may not misrepresent themselves as licensed Agents or Agencies. 10.3 Individual Users are subject to the same accuracy, authorization, and conduct obligations set out in Sections 5, 6, 8, and 9, as applicable to their role (Seller/Buyer/Landlord/Tenant).

11. Prohibited Conduct

Users shall not:

Post false, misleading, duplicate, or unauthorized Listings;
Use the Platform for any unlawful purpose, including fraud, money laundering, or circumvention of local property laws;
Scrape, copy, or republish PropVida’s data or Listings without written consent;
Harass, spam, or send unsolicited commercial communications to other Users obtained through the Platform;
Upload content that is defamatory, obscene, infringing, or violates third-party rights;
Attempt to bypass Membership Listing limits through multiple fake accounts.

Violation may result in Listing removal, account suspension, or termination without refund.

12. Content Ownership & License

12.1 Users retain ownership of content (photos, descriptions, documents) they upload but grant PropVida a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and promote such content on the Platform and in marketing (including third-party portals/partners) for as long as the Listing is active or as reasonably needed for archival/legal purposes. 12.2 PropVida’s branding, design, software, and platform content are the exclusive property of PropVida and may not be copied or used without permission.

13. No Real Estate Brokerage Relationship

PropVida is a listing and discovery platform only. PropVida is not a real estate broker, agent, valuer, or legal advisor, and does not participate in negotiations, contracts, payments, or possession/handover of any Property. All transactions occur directly between Users at their own risk.

14. Disclaimers

14.1 Listings are provided by Users; PropVida does not independently verify pricing, legal title, measurements, images, or availability unless expressly stated as a verified/PropVida-assured Listing. 14.2 The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. 14.3 PropVida does not guarantee uninterrupted or error-free operation of the Platform, or that any Listing will result in a completed sale or rental.

15. Limitation of Liability

To the maximum extent permitted by law, PropVida shall not be liable for any direct, indirect, incidental, or consequential damages arising from: (a) reliance on Listing content; (b) transactions between Users; (c) loss of data, profits, or opportunity; or (d) disputes between Buyers, Sellers, Agents, Agencies, Landlords, or Tenants.

16. Termination

PropVida may suspend or terminate any account, Listing, or Membership, with or without notice, for violation of these Terms, suspected fraud, non-payment of Membership fees, or legal requirement. Users may close their account at any time; active paid Memberships are non-refundable upon voluntary closure unless otherwise required by law.

17. Privacy

Use of the Platform is also governed by PropVida’s Privacy Policy, which explains how personal data, contact details, and Listing inquiries are collected, used, and shared. [Link to Privacy Policy]

18. Modifications to Terms

PropVida may update these Terms, Membership plans, Listing limits, or validity periods at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. Material changes will be notified via the website or registered email/contact.

19. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of [Insert Jurisdiction]. Any disputes shall be subject to the exclusive jurisdiction of the courts of [Insert City/Jurisdiction], unless resolved through the grievance/arbitration mechanism described below (if applicable).
